My brother has a little girl who is in temporary custody of her grandparents who are here on a VISA. They were ordered not to leave the states of SC and NC without his permission. He was told by the judge that he could see her anytime he pleased. They only let him see her Less than 24 hrs a week even though he would like to see her more. He just doesn't want to make the situation worse because these people are completely over dramatic when it comes to her. Once I took her to the hospital with my brother one afternoon because she had a yeast infection and was screaming of it burning. She was too young to tell us what the matter was. We were an hour late getting her back and they freaked out because we were late and thought that we took off with her. It was another two weeks before he saw her again. Anyways ---They haven't been fair at all and she never get's to spend the night with her father even though legally she is allowed to and they are not being following the judges orders at all. Their plan is to get full custody on Wednesday and take her to England or Austrailia where they were offered new jobs, where I doubt my brother will never see her again. He has his own place and is settled now with work and a new wife. I am so scared that he will loose his little girl forever. And she loves her daddy and never wants to go back home when it is time. The only reason the mother (their daughter) gave up custody, was because they threated to kick her on the street and take her car away. They are athiests also and don't like the fact that my brother takes her to church, so they discontinued her sundays with her father. They are vegitarians also and can't stand the fact that my brother feeds her chicken which she loves to death.. What should we do legally to keep her in the country and with her father when we can't afford a lawyer?

Why does the father have restrictions in the first place? What happened?

He doesn't have restrictions --- The baby was born out of wedlock and because of the split he wasn't financially able to take care of the child so the grandparents asked for temporary custody of her. He is suppose to be able to see her anytime he wants. It's just that they never let him see her and he can't take her to church and a lot of the time when he is suppose to see her they call and say something came up or they just won't be there when he goes to get her.

Both biological parents have the right to see the child and a court will order it if need be. You may want to file asap in court and get rules in place for all of this.

Ask the judge to order all parties to comply or issue contempt orders if they do not.
