10 year old child wants to live with father

My brother's daughter is 10 years old now and she wants to move in with her father.. her mother is remarried and she doesn't get along with her step father. What age does she have to be to move out and live her her dad?

Age 18, what if the child says she's being abused By the stepfather?
and if her father goes to court again with his daughter and she tells the judge she wants to live with her father? Does the father have any chance to win custody?

dad will have to prove stepdad is being abusive. as i said before, she can decide when she is a legal adult(18) where and with whom to live. a judge will not listen to the wishes of a 10 yr old.

So the child has to be 18. What if he lives in Toronto,Ontario?
I think the best bet is for my brother to get an answer from a lawyer..
His daughter is getting sexually abused by her stepfather and I don't think that is right.

and YOU know this how? bottom line, untill she is 18, your niece doesnt dictate where she lives, the court does. period.

Who are you???? Are you a lawyer or a judge??? You think that you know everything..
I want to get advice from someone who is experienced and knows how to answer my question properly.. whoever you are, your starting to really annoy me.

The child could be 12 years old and move in with their father regarding on the situation..

only if the judge allows it. as i said before, the judge decides where she lives, not your niece. ask any lawyer.

He will ask a lawyer and get the right information he needs.
He's going to get the proof he needs to prove his daughter's stepfather is touching her and abusing her.. Do you think she should stay with someone who is touching her??? I think calling the police will teach any man a lesson that touching a young innocent child isn't right.
I'm sure if you were in this situation you wouldn't sit back and wait until the child is 18 years old... by then who knows what disgusting thing would happen to them.

no i wouldnt. first i'd piledrive any pervert who touched my child, then id call the police. too bad i cant piledrive em while im pregnant( darn it!)
