Confused Niece wants to legally request for monthly child support

My niece husband is in the US Army, after their seperation (not legal) the child support comes in rarely or only at times when my niece demands for it. Now, she wants to legally request for monthly child support so that there wont be a need to beg for it. Please advise.

First of all let me remind you that both the parents have equal rights on their children. Your niece can file a petition to the court for child support. As a biological father he is bound to provide support to his child for upbringing the child. Court will consider the petition and will hear his side after that court will fix the amount of child support. Once the court orders the child support he is bound to pay the same without making any default. It is better advised that you may consult with a Family Law Attorney who can give a proper guidance in this regard.

She can go to the courts and petition for child support. But make her also aware that when this is done, the father has every right to petition for visitation. Open up one can of worms and another crawls out. See my point?
