CD has no job, can judge calculate how much she could make

I am the noncustodial parent, and I am currently paying child support to the custodial parent. She is trying to demand more, and I can barely get by with living expenses while paying for the child support. The custodial parent is currently not working. Can the judge estimate an amount that she can possibly be making so that she can't increase the amount of child support she is demanding from me.

Also, will I be able to do this without a lawyer.

The judge can do that yes. But your payments normally should be fixed as a portion of what you earn, not her general desire for ever increasing amounts.

so the only way she can demand more is if i start making more? I think she is going to try and take me to court to demand more. Will I be able to do this without a lawyer?

also, I had a question about "what if" she starts working. If she starts working, should I file to get a recalculation of child support.

You may want to call the child support offices in your state and ask what is the generally set amount for support at your level of income.
