My ex husband and I have one child, he is 4. We have joint legal custody but he is primary custodian. I want to move to TX with my fiance and his daughter-his had sole custody of her-. Our way of life would be significantly better and I would have more time with the kids. My fiance's daughter and my son consider each other brother and sister and call each other as such. My ex doesn't want to let my son go to school in TX-he won't go to school til the fall of 08. Do I have a leg to stand on?

You could try to make the argument in court if you two cannot agree; it is certainly worth a shot but his primary custody means the burden is on you to show why the move is better for all.

I agree with the poster above. The burden is definately on you to prove how your child's standard of life would improve. Consider everything - pull up school reports on sites like www.greatschools.com, pull up the sex offender registry for both houses on sites like www.familywatchdog.com. I would even pull up city comparisions and neighborhood statistics. Also, map out the time you would have with your son versus the time that you ex has with him now. In addition, you will have to prove how your child can still have a relationship with his father. I have found that to be a big thing - which parent wants to make it work. So, consider offering things like - providing transportation, giving your child's father the summer and winter breaks, etc. Also, definately go see a lawyer and take the information that you have. Even presenting your ex with a written compromise might be in your favor should you have to go to court, but make sure that you put the child's interests first and allow for lots of contact with the father.
