Question Can we collect child support for 4 years ago? (past due support)

My husbands Ex-wife is a loser and left him in 2004 to party and live in various motels. He convinced her to let us take the 2 kids instead just having them on the weekends because they were not in a stable environment andthey were missing a lot of school. We had them from 2005 to 2007 then her mother rented her a house and she took them and immediately started collecting Welfare assistance so my husband is now being charged chld support for them. During the time we had them we recieved no help from their mother and she almost never visited them. Can we collect child support from her for those 2 years??

Let me remind you firstly, you are claiming for past due support, whether that is barred by limitation or not is to be cleared. As a mother she is bound to pay child support. Since the custody of the child was with you for the two years you are eligible for claiming CS.That is the general state law. It is based by the income of each parent. She is supposed to pay a proper amount. It is further advised that you should consult with an Attorney who is dealing with family laws.

If custody never legally changed hands, no. You cannot.

You should have struck while the iron was hot and obtained legal physical custody. Then you could have gone after her for child support.

The reason women like her keep getting away with their reprehensible behavior is because the fathers of their children don't take action and allow it.

no WE cant. this or any matter concerning your husbands kids is between him and their mother( not you). you as the stepparent have no legal standing to do anything. and i strongly suggest you keep your opinions about mom to yourself. if i judge finds out you are badmouthing mom, itll cause your husband a lot of problems. same goes for getting overlyinvolved in legal matters that dont concern you.you are a legal stranger here, and this legally is none of your business.

I agree with you. If it involves your husband, no matter what it is, it is your business too. Why do these busy bodies come on here and continue to tell people that it isn't their business if they are a "legal stranger"...wtf...if you were a stranger the kids wouldn't know you..that is the stupidest term I have ever heard.
You keep helping your husband with those kids. They need both of you. Screw what the above people have told you. Keep your chin up!

Don't mind her. She's a troll who goes around digging up old posts and new, just to say the same thing. She's obviously very bitter and this is how she gets her therapy. She obviously lost her child to her ex's new woman.

Thank you two for your support and kind responses. I'm glad there are people like you two on here with some sense. I really do appreciate it...going through all of this has been tough and it was all totally new to me when I became involved with my husband many years ago. He is a good man and I just cannot stand for the "Bad Guy/Girl" to win all the time! Call me old fashioned. Well, thanks again and best of luck to you and yours.
