Fleeing abusive husband: What are her rights if there is no court order?

My sister and her two kids have lived in Ohio going on 5 years now, but her kids where born in PA. She is currently in a mental and sometimes physically abusive relationship. His family lives in OH and that's why they moved there. Her family and all her support lives in PA. He is telling her that if she leaves him with the kids and comes back to PA he will call the police and she will be arrested for kidnapping. Is this true? What are her rights if there is no court order?

She can visit for a short while but can't permanently move them without the father's consent.
