missouri- question about non-payment of child support

I'm the father of a beautiful 5 year old daughter. I pay my child support on time and have never been late and never missed a payment either. My daughters mother is ordered to pay child support on her middle child she lost in a custody battle. Well she has already had her license taken for not paying it. She has also spen 48 hours in jail for it. I'm not sure completely but she either has her 2nd or 3rd time going infront of the court for non payment. Well she is married to a registered sex offender. I'm afraid she is going to leave her with him if she goes to jail. I plan on taking her to court soon but with the economy the way it is these days. It's hard getting the funds to afford anything these days. If she goes to jail and tries to leave her with him do I have grounds to go in and press charges on her for endangerment and pull daughter out of the house. Thus making it even easier to get custody of her. There is more to this story but I'm not going to post a novel and bore everyone.

You had grounds to file as soon as she moved a registered sex offender into the home with your child. I would not be as worried about what could happen if she goes to jail as I would be about what could have already happened in the house with her there or simply out shopping.

Registered sex offenders usually have conditions of their parole that they can't be around children at least offenders that pose a rick to children. Contact the police and ask if living with your child is a violation of is parole.

You need to talk to a lawyer, call someone that gives free initial consultations. I would never let my child live in a home or even be around a registered sex offender. I don't know your story and am not judging you but get to work getting her out of there. Money is tight everywhere and you can represent yourself, the scars your child would have to carry if something happened are for life.

It really doesn't matter if you've "missed a payment". You don't pay to see your child. Are you involved in her life? Do you have liberal visitation? Joint custody? If not, why?

If you have any sort of established visitation, it would be highly likely that all you have to do is make arrangements to have the child stay with you during her jail time.

I have to ask this. If she is so out of control that she cannot keep herself out of jail, and she's living with a sex offender - and you know all of this - why don't you care enough about your child to fight for full custody of her? Do you really believe you can't do a better job of providing her a secure, safe environment than the deadbeat who is supposed to be her mother?
