Default support out of line with income: no money for insurance, food or clothes

Hello,
I am asking this for my son. We live in PA. He has three kids-custody for two of them. He just went to domestic relations today for custody and child support for the third. They held the mother to no earning potential and did not take into acct the other children. He will have to give 1/4 of his income before taxes and only gets limited visitation. He wanted shared custody. The mother does not work and has no intention of working. This leaves him no money to take care of himself or the other children.

This mother is living rent free with her father, getting free medical assistance and food stamps.

The mother of the other children was court order to pay a very small amount of support, but has failed to do that. Nothing is being done by the courts to get any of this money. I think she is supposed to pay $35 a week for two kids.

By the time support comes off his paycheck, he pays rent, utilities and gas, he will already be in the hole. No money for insurance, food or clothes or anything else.

Is there any hope for his situation? I think this system in totally inequitable.

He can go back into the court with a detailed budget and ask for a change. He will need to show there is no room for expense reduction and the budget is unworkable in every way.

I think the employees of Domestic Relations should be held accountable for their ineptness. In looking over the law, the earning capacity of both individuals is to be held in consideration as well as the well being of all children. The clerk who handled this did not make any adjustments for my son having sole custody of two other kids or hold the mother to any earning capacity.

He needs to lose more money finding an attorney to fight this and taking time off work. Money he cannot afford to lose.

I am so disgusted that there seems no way to address this other than appealing and going before a judge.

Unfortunately, that is our broken and archaic Family Court system.

It's one thing to be disgusted. It's another to lobby changes be drastically made in this circus known as "family court".

Since the hearing just took place, your son can file an objection.
Did he submit a written request for a deviation, proof that he is the legal father of the two children, and supporting documentation showing that they live with him? Also, was the total obligation for current support or did it include medical cash and an arrears monthly payment?
