Confused Vacation - Shared Parenting

I notified by ex-wife that I would be taking my son out of the state for vacation. I handed her a letter on May 13th to notify her of this vacation that would take place June 3rd - 9th. She just notified me today (5/27/07) that she wouldn't grant me permission. I have for the past four years granted her permission to take him on vacation without an incident. I've been flexible when she asked for schedule changes. (We have shared parenting, btw)

My problem is, this is Memorial Day weekend and I won't be able to talk to my attorney until Tuesday. Is this something he could get an emergency hearing for within 3 days before we leave.

I obviously don't want to just take him without her permission as that would probably come back to haunt me later. I just feel bad because we've had this planned for so long and without a court ordering her to let me take him I'll be forced to leave him behind.

Any suggestions?

If you two cannot agree on an out of state visit, it is best to hold off and try to get a judges order if need be. The court may or may not hear the issue immediately. But you can try.

It's difficult to hold off. We paid for this condo months ago. I wasn't expecting her to wait until 6 days before we leave to tell me he can't go. Especially since the last 2 years she went to Florida on vacation and I granted her permission.

You can try just going, and hope the past trips will prevent any judge from taking a position against you.
