Default Jurisdiction factor?

Our case originated in CA, the ex has moved to another state in which she has now been residing there for six months. She's threatening to have the file/case moved to her new state of residence, #1, due to the distance that she has to drive now for our court dates (roughly 4 hours), and #2, because she states that she is now a permanent resident there and 'can'. What are the chances that her new state of residency will take it over? She has our child living with her. We have joint legal custody over our child, and its been made very clear that she was not allowed to, nor has she been granted an order, to move and/or live out of state.

The original court will have to agree. And it may may very well not do so under these circumstances as you have described them here.
