[FONT=Calibri][SIZE=3]I have 2 children –[/SIZE][/FONT] [FONT=Calibri][SIZE=3]A 12 yr old daughter and a 14 yr old son [/SIZE][/FONT] [FONT=Calibri][SIZE=3]Today my ex husband (who is recently married) informed me that our daughter wishes to live with him in WI permanently. I reside in MN [/SIZE][/FONT] [FONT=Calibri][SIZE=3]Facts: My ex and I have been divorced for approximately 6 years[/SIZE][/FONT] [FONT=Calibri][SIZE=3]In that time he was first ordered to pay $633 for child support of both children and carry their medical ins . Approximately 2 ½ years after this order, he lost his employment and then lapsed on his child support payments. [/SIZE][/FONT] [FONT=Calibri][SIZE=3]Modification of child support was filed by him and was approved by the courts but only based on his “potential income” as he had chosen to be unemployed so that he could be a full time student. – Modification ordered approx $425/month, me to carry the medical insurance of the children until he was employed and then revisiting of their benefits at that time (this was never done – I still carry their medical ins) He was also responsible for payment of any back child support prior to the modification (this also did not occur) [/SIZE][/FONT] [FONT=Calibri][SIZE=3]In 2008:[/SIZE][/FONT] [FONT=Calibri][SIZE=3]A few months after modification had occurred, our daughter began having more and more emotional issues due to her not “fitting” in at her school that she attended (this was in a rural area of MN)and was very unhappy. Because or her unhappiness and being locked in my lease, I agreed to allow her to live with her father (who at that time resided in Otsego MN) for a year also with the condition that she see a counselor while there (this too did not occur). In late March of 2009, my ex husband informed me that he was laid off from his employment and that he and his fiancée (at the time) were moving to Wisconsin to go live in the Cabin that her parents owned and that he wanted our daughter to move there as well. He tried on several occasions to have me sign over an agreement to this to which I put off. In April of 2009, my daughter informed me that she was unhappy and wanted to come back home but to not let her father & his fiancee know till after the school year ended so as not to create any problems for her at their home. We did not inform my ex nor his fiancée until the end of our daughters school year that summer of her decision so as not to create any disruptions. Permanent residence was never established for my daughter outside of MN. [/SIZE][/FONT] [FONT=Calibri][SIZE=3]During the time that my daughter was at her father’s residence, no paperwork was ever filed with the courts for either her change of residency nor for any modification of child support even though none was paid for that year nor has any been paid until approximately April/May 2010 – 3 checks totaling $325 and $150 in September to “cover” his cost of the $600 I had spent on their school supplies/clothes for the 2009/2010 school year (not including any cost for the children’s school activities). Could you please let me know what my next course of action should be as this is a very upsetting matter. Thank You[/SIZE][/FONT] |

how about with all the comments on what did not happen you as the mother should have made things happen. You made it happen that her father not find out that she wanted to come back with you, and letting a child make decisions like that isnt good for the child at all. Your a disgruntled bitter ex thats what you are.

Funny, all I read out of the mumbo jumbo was that she was upset over child support. Was this to be paid to YOU and you are upset because you didn't get it? Well, if the child was NOT with you, why do you feel you are entitled to the money?
