My ex-wife is filing a modification to raise my child support, which was established in 1998. I currently pay $360 per month. I bring home about $2200 per month now before mortgage ($1300) and gas ($150) and we have not paid utilities or eaten yet. Do you think the court will raise my amount? I live in Florida.

You do realize you are only contributing $4,320 per year, yes? That is less than the cost of health insurance.
How many children are you supporting? It's not the court's problem that you decided to buy a house that costs $1300 per month. You have choices in that regard. If you can't afford your mortgage once child support is factored out, that's your problem. Child support comes first. Depending on how many children you are supporting, it's entirely possible the amount will be raised. If your income has increased, that will also be a good predictor. It's highly doubtable you have not eaten yet. Please, don't over dramatize. |

Not trying to be over dramatic. I am just wondering. I have never missed a payment in 8 years and have my son every weekend Fri-Sun.
My house is nothing fancy...are you suggesting I should buy a cheaper house in a bad neighborhood and put my children's well being at risk? Obviously if you think $1300 a month is expensive for a mortgage payment you either live with your parents or don't know what you are talking about. My ex has a bachelors degree in education and is too lazy to use it. You really seem angry. Maybe you should seek mental advice instead of giving your opinion to others on legal matters that don't concern you. Have a blessed day! |

Thank you for your reply. I honestly don't know what amount they based the original amount on. I am making more now if you look at gross income, but with the increase in the costs of insurance, ect. net wise I am basically the same as I have been for 8 years.
I don't even mind if it's a little more. I love my son and would do anything for him. I was just gathering opinions. Sometimes non custodial parents are made to feel like deadbeats even if they have never missed a payment and that is a real shame. I have my son every weekend Fri-Sun. I have never been late picking up or dropping off and have "shared custody", but when you get a letter basically saying: You ex wife and the state of Florida vs. You, it's a little intimidating and quite frankly insulting, especially when my ex has a bachelors degree and refuses to lower herself to work. |

I would suggest you simply Google 'child support calculator Florida' ever state has something online that you simply fill in and it will determine how much child support is payable based on the information you provide. It is confidential and can be done in your home.
I understand your debt vs income problem but child support is always based on a state calculator. You can argue the court as to why you should be different but unless there is a really good reason with really good supporting documents I wouldn't expect it to be varied much without your ex's consent. So the answer to you post is: Yes she can ask the court to change the amount but the court will simply ask for financial information and put that information in their states calculator. If the court is not satisfied you have provided all financial information or are hidding assets to avoid child support (Not saying you are) they can impose an imputed income and put that into the calculator. Google it and don't argue with anyone here about how much you make or how lavish your life is or is not. Everyone has an opinion but it all comes down to state calculations. |

You people- including the Op - are incredibly sensitive. That you got so emotional over such an innocuous post is testament to how childish adults really are these days.
Since the OP is not really looking for answers, but is here, apparently to blow off steam, he can figure it out for himself. Nobody suggested the OP "lived lavishly". $1300 hardly constitutes lavish. Nobody attempted to "make" the OP "feel mad" about where he lives. Those responses are just plain asinine and do not merit a reply. The only thing was was said was that children cost money to raise, which is true and logical. The money the OP pays per year is less than most people probably pay for their cell phones and high speed cable per year, but nobody is complaining about those costs. Sorry if logic and the truth hurts you people so much. The truth always does hurt. |
