Confused New York- Married Custodial Parent/Single Non-Custodial Parent

My ex just filed for child support. We had an arrangement of $300 per month and I paid monthly. Last year, she asked if my son could live with me and she would pay me child support. He stayed with me for 6 months and she didn't give me any money. We agreed that I wouldn't pay her child support for 6 months. Now, she's suing me and I'm still trying to recuperate from him living with me. She is married to a man in the army, living on base, paying no rent, with 2 jobs and I am single, struggling financially. Will the courts take my son's living with me, the past child support I paid, her household income and mine into consideration before determining the amount of child support I must pay?

I would like to inform you that court fixes the amount of child support keeping in view the best interest of the child. In this, the court will give due consideration to the income of both the parents. Generally, the support amount is paid to spouse with whom the child is living by spouse who is not keeping the child. The past acts of the parents are taken into consideration for determining the child custody and thereby the child support. You can present your income and necessary expenses which you have undertaken for your son to the court and the other parent's income may also be shown to the court. The court will take all facts presented to it into consideration and decide the matter in the best interest of the child.
