Exclamation father asking for alternating claiming child on taxs

the father of my child has recenly filed for joint custody(60/40--me having her more). Along with this he is requesting to alternate claiming our child on taxes. He makes around 60k a year whereas i only make around 17300. He pays child support and i know that when they figure child support they figure it as the cp claims the child every year. What happens if anything if i choose to let him claim her?? what am i loosing out on if anything and because he makes so much more then me would he benifit more because of claiming her??? Also i was told that if we took this to court that the judge would rule in his favor---why would this be???

Unfortunately, I do not know the answer. However, I do know that if it is stated in youf paperwork that he gets to claim it and it's signed by judge, most likely you will not get it changed. My paperwork stated that it would go according to the tax laws of the custodial parent, me. That fortunately played in my favor. It said that whoever the child lives with most of the time and supports them, not via child support, gets the right of claiming them, w/a few other things. So I guess it depends on what was ordered by the judge. If it does not specify you can try for every other year or try checking into the tax laws and see if the court will grant you that right. I get to claim my children every year. Have a good lawyer check into it and or do research of your own. It does make a difference. Good luck!

Yes, financially he would benefit from it. If you get it, fight to keep it. It will help you out.
