Ok where to start. I have court ordered visitation with my daughter. Ex had a dfcs case and to close that and get them out of my daughter's life guardianship was signed over to her parents. (I could not afford and attorney to get custody) IN the guardianship it stated that my visitation was not to be messed with. The grandparents have allowed my daughter to stay with her mother the whole time they have had guardianship. I had it planned to get her at Christmas for my time and ex asked could she come one day later to do some Christmas things with her so I said yes. Then the next day it was something else. I ended up not getting her at all for Christmas and haven't seen her since. My current wife and I have both tried to call and get my daughter but ex usually doesn't answer or return phone calls.
My question is how do I take this to court with the grandparents having guardianship and can I get the order changed to where When it is my weekend they leave me alone. I want my visitation enforced to where we pick up my daughter at a public place. How do I go about doing this and what are my chances of winning? ok then i can't tell you about georgia, only my experience here in nyc.
the first thing i did was document that she was not giving visitation. go to the home to pick the child up on your appointed day and time. have your visitation order with you. if you don't have one go the courthouse and get an official stamped copy of of one. if the child is not produced call the police and file a report .. on the spot... and then bring those to court with you to prove what they are doing. also when you call the child, and call every day, every call i make on my cell phone shows up on my bill. so if they claim you don't call , or they are letting you speak to child, produce bill which will show a one minute phone call every day , proving you are not having conversations. i went to court and filed " visitation violation" and " visitation enforcement" ... may case is still ongoing ... if this keeps up you may be able to attempt to get custody of the child by proving parental alienation. good luck! |
