custody battle
in our divorce agreement, we decided at the time it was best for the father to have only physical custody of the children. two years after the divorce my daughter told me that her father had been molesting her so i removed her from his home which was the advice of child protective services. a year ago he came to me asking to take all the children, of which we have three boys and one girl. This i immediately agreed to since he claimed to be homeless. the children have been with me all this time up until recently. i went on a 5 day vacation and asked him to take the boys, he agreed. the problem is that my eldest son has not come back. i asked for him to call but no response, he won't even tell his whereabouts or let me know if my son is okay. i do have the other two boys. the boys have told me that they have slept on the car, at the parks, under the stairwell a number of times due to the fights he gets into with his girlfriend of whom he supposedly lives with at current. i fear for the safety of my son whom is fourteen years old. i know how much he loves his father, but i have seen this woman slam the door in my sons face and have claimed to police officers that my sons had no belongings at her home of which i tried to retrieve. i really would appreciate it if you could give me some advice on what to do.

If you have a custody order the police will go and get him and/or check what is happening.

i showed the police the custody order and they cant charge him for any criminal act because on paper he still has physical custody. but, they told me they would make an effort to go to the address i provided and see if he's okay. it;s been two days and i haven't heard from the police, so i called. a different officer advised me to "just do it on your own with the courts. don't wait for him to change the custody." so i did. good news! they will motion for a change in custody and subpeona him. best advice i got so far! thanks for yours.

in your custody order, does it say anything to the effect that he must keep you advised about any problems or progress regarding the upbringing of the children? if so, I'm not sure, but you may be able to hold him in contempt.
