Confused Visitation, Noncustodial Parent (NCP) - Alabama

Alabama;

What should you do if you are supposed to have visitation and on the last visitation weekend there were some problems(between mother and father bc of children behavior) and CP said the kids would not be back and NCP would be hearing from her lawyer but there was never any contact from lawyer and the NCP tried to contact CP to find out if CP was going to allow the NCP to have the children for their court ordered weekend visitation and the CP does not respond back?

CP and children live 2 hours away (CP moved).. and its already expensive enough on gas but to go and the CP not give the children for visitation is even worse.

Question:

Should NCP still drive 2 hours to pick up kids even if they are not sure CP is even going to allow the children to come?
or
Should NCP keep record of text trying to contact CP and not go?

Is it going to hurt NCP if they do not atleast attempt to pick up children and let the CP decline the COURT ORDERED VISITATION?

To your last question, a resounding YES. You must not allow her to get away with dictating the child custody order. If she interferes with it and violates it, you must file a Motion to Enforce the court order.

If you continue to allow her to walk all over your establishes legal rights, she will continue to do so.

Instead of sitting idly by, waiting to "hear from her lawyer" (she was blowing smoke up your you know what), get proactive and take HER to court for violating the court order. When she racks up enough violations with the court, custody will be reverted to you by default anyway.
