Default Paid child support 14 years, but I am not the father

hi i was paying child support for 14yrs. for the last 11yrs i been trying to get a DNA test i was granted one 2009 the test comes back that am not the father and i need help with retrieving my money back because the master said its nothing he can do

In this as you were not allowed to have DNA test before, therefore, you can make a claim for refund of all the money paid by you in child support. In this you can argue that the child support was paid by you under a wrong impression and you were making efforts to have DNA from last 11 years to know the truth. As now truth is out and you have come to know that you have been duped, therefore, in the interest of justice and equality you should be refunded all money.

Very doubtful that you will get a refund of amounts paid. You should have disputed paternity at the time the order was entered. Consider the amounts you've paid a "stupid tax."

It's counterproductive and inaccurate to label a father wanting to support who he believed to be his child "stupid tax". At least give the man credit for doing the right thing all these years when a lot of biological fathers fight so hard to avoid paying for their own natural children.

To the OP: you will not likely get a refund on that money, and really, wouldn't it be petty to do so? You loved this child as your own all these years didn't you? It's not the child's fault you're not the father. It would be punishing the child to back out now. The child has 4 more years left as a minor. It's understandable you're upset and finding out you're not the father, but that issue lies between you and the mother. Not the child. Don't punish the child over this.

In my opinion, the word "stupid" is sometimes appropriate when used in the context of someone who sits on their legal rights. If this person had doubts about paternity, he should have acted sooner. I simply don't believe it took 11 years to get a DNA test. The court system is slow but not that slow. In the state where I live, I can file an action to "disestablish" paternity and have the court enter an order for a DNA test within a few months, not years.

Stupid is actually judging others when they do not have first hands experience. Attorneys are expensive, and after paying CS some fathers barely have enough to live. ....so do not judge him unless you have been in his shoes, I also have a child I have very reasonable doubt that a child is not mine, but i cannot afford to fight, and child support does not care just so they can order a high support amount so they get awarded from fed. 60 cents per dollar......

Your local Walgreen's or Rite Aid (or any other drug store) conveniently has paternity dna tests for your convenience. They're relatively inexpensive. All you have to do is swab your mouth and the child's mouth.

Once you complete that test and get the results, you can then petition the court to order a paternity test which will hold up in a court of law.

It's amazing how in this day and age men don't know enough to double wrap it before having sex with any woman. If you don't plan to marry her, protect your sperm from getting out of the cage.

Did have plans to marry her. Worked 2nd shift and machine broke down so was sent home early...was very surprise to see she shared our bed with another man. Later found out from him that it was not the first time..two yrs before they had a fling, which is why there is reasonable doubt to if the child is mine.

Those tests only work if the Mother agrees and signs the paper work, they will not do it otherwise.

Incorrect. The tests "work" regardless of who signs anything. Further, no father needs the mother's "permission" to perform a dna test on himself and his child.
