My Brother's x-wife is in prison for meth and ammunitions and breaking her parole. She will be there for a paltry 5 years. He has custody, which that was even hard for him to win. Her parents decided to take him to court, with SRS's help, to stop all child support payments for their 2 children in his custody. Their feeling was that since she is in Prison she cannot afford to pay her 93.00 dollars a month (yes, that's right, the court here already reduced and approved her reduction) and they do not want a large bill when she gets out.
My brother showed up without representation as he did not need any. The Judge in this case had already sited law that said Prison was not a reason for not paying child support. He made his ruling that child support shall continue based on this law, although she has not payed anything anyway. My brother now gets a bill for $1800.00 from the courts that he has to pay. Court costs and Fees. His ex-wife and parents, who brought the case to court, do not pay anything. What is going on here? What can my brother do about this? I don't understand at all. If he didn't bring the case to court, and he won the case by the Judge's ruling, why is he paying all court costs? (Yes, I will say it, his ex-wife and her parents are "In Bed" with the judicial system here in kansas). Anyone? Help or advice? My brother and his kids are struggeling enough without this crap. Thanks!!! |

he should not pay--ask for a motion to reconsider or at least ask the judge why he did that...
