Default Child Custody in Philippines -- I Want to Have a Sole Custody

hello sir/ma'am,

i would to ask if i have a very chance of child custody here in philippines... i know that in my country children below 7 years old is cannot seperated from the mother... but now all my children is above 7 years old...

their mother denying me of visiting starting this month of december... and we will be going to legal matters... and i want all my children to be in my custody...

their mother and i are married but seperated or not living together for 6 years... she live with someone else... but they don't have any children... she has no job... no other means of supporting the child on her own... i'm the one supporting the child... every month i send money for financial support...

and me... i live with someone else too... have two children... i have a regular job... i want to have a sole custody of our children... for better education and support...

what is my chances of getting a favor in court..??? is my affair and two children will be causing any problem in court...???

hope anyone can enlightened me about this matter...

The main consideration for custody of child is the well being and welfare of the child. The Court looks as to where are the best interests of the child. Custody can be changed from mother to you if it can be shown that there are compelling reasons for change of custody to you. Now as your children are above seven years of age, therefore, the Court will give due weight to the choices of the children as to with whom they wish to live. If they wish to live with you Court can change custody after keeping other considerations in mind.
