Default Grandparents rights: Me being maternal grandmother...

My daughter passed away in 2007. My grandsons biological dad has never been in his life and is a dead beat dad. He signed his rights away to a niece of mine, then revoked the affidavit and signed me as Primary Conservator. My niece his Great Aunt through marriage is fighting me for custody of my grandson (right to fight given to her because of fathers relinquenched rights for ten days even though child had not lived with her and he revoked the relinqueshment). Were under temporary orders and are going to trial. He is in prison and he\'s relinqueshed his rights again and given them to him. She wants to adopt my grandson. Will she be able to do this inspite of prior filing of me being primary conservator? Me being maternal grandmother.

Hi there. You have a complicated situtaion here, and the bottom line is that the only reliable way to get some guidance would be to have legal counsel review the specifics of your circumstances. I would suggest that you visit the WLD main page and either submit your inquiry for legal review (it's a really reasonable fee) or ask for a referral to a lawyer in your area.
