Big Grin Can Dependents be claimed by Father if late/not paying Child Support New York State

NEW YORK STATE - I've received a letter from the IRS that my dependents have been claimed by my ex for 2008. If he is late or not paying (both) Child Support, I heard he cannot claim the dependents. The children see him 4 days/month, I am struggling to stay above water as is.

Does the child custody order stipulate that he can claim them?

Yes but he has a very poor record of paying late, not paying, etc.

typically...if a parent is behind (there may be a "minimum") he/she cannot claim the child. You should check your child support papers and you may want to post to the ask an attorney section here. It's 10 dollars.
