Need advice about custody
My ex boyfriend and i have a little boy together and about 2 weeks ago he kicked me and my son out. We have established that he pay 150 a month and see his son one afternoon a week and every other weekend. He has his own home and i am currently living with family. He showed no interest in keeping our son when he asked me to move out. I have always taken care of our son and been a great mother while he goes out and hangs out with freinds. I have been considering filing for child custody and support and was wondering if there was a chance of me losing my son just because I live with my family instead of having my own residence?

You can't file for custody as you already have it.
Living with your family will not hurt your chances of maintaining primary custody under normal circumstances. Filling for support will likely be followed by him filing for custody/visitation. You may want to start lining up a lawyer now....or try to go it alone and not file support. I get slammed on for this advice but after I filed for support I ended up in a 15k custody battle when I couldn't beg him to see her before. Then they even cut my support in half for only a slight modification over the "standard" order. After the stupid extras that he keeps dragging me back into court for, I anticpate legal fees will end around 19-20k. Therefore, I recieve 17k in child support until she reaches 18....and will be in the negative. I wish with all my soul that I never would have filed. Had I taken advantage of assisted childcare - I wouldn't have had to. |

Why are you wanting to do that?
What will the order give you that you don't have now? Are you worried that you need a court order for some reason? |
