We are not yet divorce and she lives out of the US with my son. Can she file Child support without divorcing me?

If you are legally separated, I believe she can, yes... If there is no agreement currently between the two of you on how the child is being financially supported.

if separated or divorcing yes...otherwise normally only if she can show very unusual circumstances such as neglect, abuse by withholding normal care, etc.

Check DOS website and check the country she moved is Heg International court signatory.
If her residing country is not a signatory then do not worry about child support order from that country. If her residing country is signatory then she can claim child support through local court ruling. If your child is US citizen then file for a child custody in US court. |
