wife left with kids, no contact info

Wife took off for texas 2 days ago and left note saying she will not call or let me see the kids. She is going "for good". We never had any problem or violence or anything.

What is my first step now? I have no idea? How to get my kids.

File an ex parte emergency custody order. She can, in effect, be charged with kidnapping.

It really astounds me every time I see or hear one parent try to impose onto the other the terms of when or whether they can see and have access to their own children.

She needs a lesson in reality about her not calling all the shots in regards to whether or not you see your kids. She cannot dictate that.

Have her charged with kidnapping and get emergency custody of your children.

then she files for CS and claims you have nothing to do with them. typical. but you can beat her.

She can't be charged with kidnapping unless he had primary custody or a custody schedule in place.

An exparte for custody and/or visitation should indeed be filed.

He did not mention separation, divorce, or anything regarding custody schedules.

No...she can't be charged with kidnapping. Are there any papers that say he has custody/parenting time? They BOTH have custody and that doesn't default to 50/50 or any parenting schedule until a court lays one out or the parties agree. She has as much "right" to move out with the kids as he does/did. Now the courts need involved....QUICKLY.

There has to be a custody order in the case of divorcing or divorced parents. If there is no custody order, a parent can't be charged with kidnapping (when married). The disappearing act she is pulling will NOT bode well for her in court however.

She is violating fathers right to see baby. File for child custody even you are married.
If she doesn't respond to it she will definitely going to loose the child custody.
You must report your local police station that your wife took the baby and is not back yet.


My wife filed phony PFA and moved out. I filed custody complaint and I got alternate week friday, sat, sunday overnight stay. I received shared physical and legal custody. She was furious over this. Now she filed divorce.

Will wait for next 90 days.
