Non Costidal Florida Parent needs advice

I just recently moved from the west coast of Florida to the east coast of Florida. My son and my ex girlfriend reside on the west coast of Florida where the child support case is in. The last time that I saw him he wanted to stay with me and not return to his mom. No custody was ever determined by the court systems. I was ordered to pay child support though and neither parent is to leave the state of Florida with the child.

I am in fear for his safety and well being after finding out DCF had investigated her in March 08 and May 09. His mother lied about my where abouts when talking to the DCF investigators.

The first time DCF was called out was when her when her 9 yr old's sons father committed the act of Felony Battery by Strangulation Domestic Violence on her and Witness Tampering on his son and his son's older half brother. The father lost all rights to his son after he was sentenced to DOC for 2 yrs. The second time DCF was called out was when the school called on her. She was accused of allowing all 3 children to attend school unbathed and with dirty clothes. A few months ago someone sent me a news article they found on her. It stated she allowed a homeless man to stay the night with her back in January of 2009. The said homeless was later located within her residence the next day as he was wanted by the Hernando County Sheriff's Office for the charge of Murder. I contacted DCF the very next morning after learning of this disturbing information and the investigator refused to return my calls as did the supervisor of the CPI office. I do not what to do since DCF is turning a blind eye to her lack of judgment and neglect of my child.

Being that I am considered the non custodial parent will it be considered as kidnapping if I do not return him back to his mother?

You should get a lawyer and file for emergency custody. That would be the start....
