my wife filed for devorce over a year ago i was not served but went anyway it has been posponed several times do to us trying to work out our marrige she has now refiled and again i have not been servied the date is 4 days from now and im not ready with such a short notice from her only do i have to go. the 1st time we went the judge sent us a provision order stating everything she and i are resposible for, my rights with our 2 boys were to be scheduled by the boys therapist with the Indiana parinting time guide lines she says the therapist said that they didnt need to be with me at all.there are no papers submitted to the court saying so for 16 months if shes not mad at me i can do what ever i wont with the boys but when shes mad which is most of the time i get nothing

get the court to set exact times when you have visitation and make her abide by it
doesn't look like doing it by agreement will work |

thanks for the info. i havnt any money for a lawer by the 16th. i have paid every bill she has had for 16 months. now that my job is a risk and the hours i use to work to pay everything is not there , now she is going to try and hang me couse the child suport was paid in cash to her and now she clames i have not been paying. but how can a person be held accountable to be a court when they were not served

Regardless of whether or not you were served, it is in your best interest to show up in court on the date your case is going to be heard. Otherwise, you will lose by default.
Paying in cash, as you're learned the hard way, is a very bad idea. |

Yes...definately go. Served or not. How old are the kids? Typically kids can't "opt out" of visitation until at least 16 yrs old. Even then, not really legally. You should insist on at least the standard time share agreement for your county (ie every other weekend and mid-week) with shared legal custody (if your state specifies that as an option).
