Ohio Child Custody
Is a magistrate allowed to rule on a motion that was presented orally on the day of a hearing that I was not able to attend? and I had never seen it before? Am I entitled to a copy of a court ordered psych eval as a pro se litigant? If someone was granted (anything), while being represented by legal aid which they were not entitled to, (for financial reasons,) and they (legal aid) subsequientally withdrew from the case because of it, is there any remedy for the other party who suffered (or taxpayers in general, since taxpayers dollars pay for this service) that the person utilized their service and benefitted, but without actually being qualified. I only came to realize it after going to Legal Aid for my own need, and was told that conflict exists. I believe the case was purposefully disclosed, knowing finances would not qualify, to keep me from having representation at all. Prior to legal Aid, opposing party had hired and fired more than 3 attorneys in this case. Opposing party about to be given sole custody, based on lies (documented for evidence) told to court psychologist and the fact that we (almost always opposing party) cannot cooperate well enough to continue shared parenting , which was journalized 8-07. NewTrial date set for next month. NOTE Custody originally journalized 8-07 naming me residential. NCP then filed change of circumstance 11-08. I missed a hearing 1-09. Legal Aid attrney was at that hearing and filed a new motion (I never saw it) and NCP given temp. custody. Child was literally taken from my home with no notice (violating existing order). At next hearing (motion to set side ,Pro Se) Legal Aid motioned to withdraw. NCP consistently not following current order,(medical, school, and daycare communications etc...) from 8-07 and acting as if given sole custody even though judge stated current order is still in full effect. Child suffering terribly in school and with depression and anger issues. Wants to come home desperately. 10 1/2 yr old. Seeing private psychologist, interventions at place in school. When custody was temporarily changed and child Support was stopped, after then being laid-off from my job, I was forced to move from the home that the child and I lived in together. I'm a Full time college student laid-off from my job, forced to move back in with my mother, while working through this legal mess. Any Advise??? |

well first off, stop acting like you care that the taxpayers were on the hook for the Legal Aid. YOu are looking to last back.
this is what happens when people that have no legal knowledge go into court unprepared, missed hearings, etc. These cases are the MOST important thing that can happen in your life, you tried to save money, and now are screaming unfair....Buck up people, sell things, whatever you have to do, or expect thing to not go your way!!! You arent going to find some miracle legal loophole to get your kids back on here How many different posts on here are yours? |
