I go to court Wednesday on visitation with my daughters. I am also asking for my child support to temporairly be lowered untill i can find a new job. I do not get no where near what i was making working than i do now drawing unemployment. Also my unemployment runs out in November. My question is does the judge still have to decide my child support based on me having a minimum wage job? Or is it set off the current amount of unemployment that i draw? Also will the judge still take into acct that i carry insurance that we pay out of pocket?
The last time we was in court it was ordered for me to not pay child support. But i did send money anyways. He went and got put on welfare, since he's a non parent that has custody they do not take into account his income. Which is around 500,000.00 a year. He also receives medicaid, and food stamps. Isn't it great to know that our system allows people like him to draw these benefits, when there are more deserving people out there? He only did it because he lost one part of the case and was determined to win one way or the other. My new lawyer intends to bring this and other behavior that he has had towards the court orders in court. Its his way or no way. |

It is up to the judge really on what they want to do. It really depends on how you sell it to them. I would hope that the system will have a heart toward parents who want to do the right thing and be a part on the lives of their chidren.

Most States require income limits before qualifying for aid. How did he manage to get State aid on his income? That's very odd.

Because he is considered a non parent custodian (grandfather) they do not take into acct his income. I guess they consider him as a foster parent. And foster parents can draw TANF for the children. The entire thing seems to be unlawful to me. I understand their are grandparents raising their grandchildren that actually need the check, but i think there should be some kind of guidelines for them to draw TANF also.
