Child Support & Custody when "SPERM DONOR" is NOT paying...

Ok,...I have a 2 year old daughter. My ex boyfriend and i got pregnant, and when i did he dumped me. well...he was cheating on this OTHER girl WHILE he was with me. well,..he ended up goin back to her and she ended up pregnant. Threw out my whole pregnancy i kept telling him how everything was and told him it was a girl and what her name was and everything. but he refused to go to the doc apps with me and everything.

well,...he wanted to get DNA done, cuz SHE was mad and was callin me the town ***** and everything else. so when the DNA came back,..by this time my daughter was already 6-7months old. the 1st time that he seen her was when she was 10months old, and that was for bout 10mins cuz SHE wanted to go home. well..the next day THEY came to my house and what not and ONLY stayed for bout 10-15 min cuz SHE was tired and was ready to leave. remind you THEY have a child together. THEY are now married with 2 children. HE has 4 children, by 3 different women and ONLY takes care of 2. Which are by HER.

We went to court to have child support done and what not. he has NOT paid in OVER a year. well...when my daughter was 7-8months old, i got married. my husband is in the Army. My daughters "SPERM DONOR" DONT see her, DONT call to check up on her, DONT pay child support, DONT get her nothing for christmas, birthday NOTHING!! N-O-T-H-I-N-G!!!! he has NOT seen her since 9/14/08, and today is 9/23/09.

My question is...Since my husband is in the military, and with us movin from post to post, cuz he is in the Army, can HE get me for kidnapping?? Even tho he DONT pay child support! and it is in the system. He has to serve 30days in jail on 10/5/09 cuz he has NOT paid and is NOT doin the work seek program!

Can he get me for kidnapping?? And how can i get his rights taken away to where my husband can have them and sign the birth certificate??

you can't take his rights away, because they are his and most importantly your daughters. what you need to do is file for custody, but you must live in the same state for 6 months. You HAVE to have him served as well. The courts dont care about CS when it comes to custody or visitation. There is no cover charge to see your child, so move past that when it comes to his rights. If he does not pay for a long period of time, and has nothing to do with her you could have your current husband adopt her, but if i were you i would talk to a lawyer.

You can't file for custody if your an unwed mother. Because you already have it (at least all of the US that I am aware of). You are currently the sole residential and legal parent. Check with an attorney in your area, but he has no rights until he files with the courts requesting rights of custody/visitation. You are free to move as you please, I wouldn't even tell him. But again...check with an attorney in your area. There may be some states that are different...but I've not yet seen one.

You never did mention whether the paternity test came back naming this man you're complaining about as the father. Your tedious post was meant as a mere diatribe presumedly.

Can he get you for kidnapping? If the child has legally been established as being his, yes.

Can you get his rights taken away? No.

Can you have your new husband sign the birth certificate? No. He is not the biological father and a birth certificate is like any other vital, legal document. It needs to be filed with truthful and accurate facts. Besides which, the birth certificate should have already been made out and signed 2 years ago when your baby was first born.

if your husband signs the bc, and you both know hes not the father, youll both be committing the crime of fraud, and you risk losing custody of your child.

This is VERY incorrect. If there is no custody/visitation established you could move to a different country and you don't even have to tell him let alone get a courts permission.

If the father wants to have your husband adopt the child, he can get his rights to pursue custody and visitation removed and also the obligation to provide financial support removed. This would make your new husband the childs legal father and he would appear on the birth certificate

Losing custody to who? The father doesn't want the child. You think they'd put the child in foster care? But I don't see how this could happen anyway...there was a DNA test to establish the bio father as such and he is paying support. He is VERY likely on the birth certificate now if you go and request a new copy.

1. Get counseling, and take a grammar class
2. He is as much the "sprem donor" as you are the "egg donor", HE IS THE FATHER OF YOUR CHILD.
3. Child support and visitation are separate.
4. Your husband has NO right here, these moves will cost you in court, if the childs FATHER decides to go after you.
