What, if any, developements have been circulating in the California Legal system regarding Parental Aleination Syndrome and how difficult is it to prove?

Google is likely what brought the poster here. I find it irritating when you do searches, find a board...ask a question...and they tell you to do searches.
Parental alienation syndrome has been debunked. Parents can however engage in alienating behavior...it's just not a syndrome. One of the tests for determining custody is "the parent most willing to facilitate a parent child relationship with the other parent". While this may help you in your case, it's the same clause that puts children in the hands of abusers. So...don't try the term "parental alienation syndrome". Richard Gardner who coined the term was in fact a pedophile who committed suicide. |

well the advice on google will be written by people that actually study these things, not a bitter housewife who got "screwed" by a man and the courts and uses thos board as therapy, while often giving incorrect information.
GBYTE can you please post your source for that statement? Im guessing NO as usual. IT has not been debunked. A womans right group tried to get a bill passed that would outlaw it in California, but it did not get through! Why dont you stick to what you know and post on a "how to get stains out of laundry" board |

While it may not be a mental disease, and Gardner's stance on it extreme, there does exist a pitting of one parent against the other all too often. I, myself, was subject to it when I was a child, by my father. And that wasn't yesterday.
Richard Gardner committed suicide due to ongoing pain and complications from a neurological disorder. "Google" as I might, I can find no competent evidence that he was "in fact" a pedophile. |

gbyte is right---all reputable mental health professionals reject PAS
sure some people may alienate but it is not a syndrome and shd not be treated as such--the AMA also agrees it is not-- |

Most judges will not buy into the idea of PAS. The only way to prove this kind of emotional / mental abuse is to have the psychological evaluator give a professional opinion. Unless you get a professional involved, you cannot prove that the parent is purposely sabotagging your relationship with the child. Good luck! I've tried this one before and got no where.

And it is WIDELY used in Canada already. By the way, the custodial nonparent has already tried to fight the use of PAS on my side and he has lost. But do not get me wrong. PAS is VERY hard to prove. |
