Default Custody and visitation: My sons girl friend threating my son

Ok I have my sons girl friend threating my son that he wont see his daughter every time she gets mad my son has become reasonsible ever since his girl friend came out pregnat and we paid every thing she needs and she is very selfish and does not let us see my grand daughter which i think isnt fair i would like to take the custody because the baby is sick again right now and she refuses to take her to the doctor because she dosent want to pay even though My son is willing to pay what should i do ????

1. Has your son been legally established as father? If not, he has NO right to see the child. Nor do you.

2. If so, has child support been set up? If not, everything is considered a "gift" so far.

YOU have no rights, nor any chance of gaining custody of this child. YOU cannot even attempt anything until its proven legally that he is the child's father

Sure...let's all bet. If the first and third post are from the same "grandparent" I hope they tell you to shove it.

Otherwise:
My ex tells me I have to take my 6yr old to the doctor every time she gets a cold. Um...no. Being sick doesn't automatically mean doctor. That's part of whats wrong with our insurance system and medical system. A runny nose has irrational people running to urgent care. If it's not a 100+ degree fever for more than a couple of days, it's likely a bug that has to run it's course.

Grandparents can get custody in neglect situations. He needs to file for paternity, start paying child support and get a court established visitation schedule setup.

If "grandma" ( i used quotes around it as you are NOT legally grandma yet) posted above, yes i will bet.... your emotions and what you feel is right, will not supercede the law. If you find a lawyer that tells you he/she can get that for you, go ahead and waste your money.

You might want to read up and Grandparents rights, or lack of instead of the tough talk. Probably could have done a better parenting job and maybe you would be in this circumstance

To the original poster: if you are the grandparent, you cannot take custody of the child. Only in very extenuating circumstances would that happen.

If your son has NOT been legally established as the child's father (i.e. did he sign and Acknowledgement of Paternity, is his name on the birth certificate with his knowledge/consent), he really has no right to the child right now. If the above HAS been established, he is under no legal obligation (meaning police won't come take his child if the mother goes to them) to return the child when your son has the child. His only recourse is to file for temporary custody of the child.

what makes you think you have any rights to a child thats not yours? when your son establishes paternity, if mom is proven unfit, he, not you, will be first in line for custody. you can do nothing legally where this child is concerned, now or in the future. you are not this child's parent, and never will be
