Okay, my situation is very long and very confusing. I am married since 070609 to A military man (navy!) But outside of our marriage a i have a one year old daughter. My husband is Stationed in san diego, He is on deployment and gets back end of jan 2010. I am currently in A situation, I went to court the 30th for a restraining order i put on my Baby's father And There the judge told me that he had a petition for joint custody, He waived it asked me to drop my restraining order and told us to go to a mediator for visitation, (this is the same judge who married my husband and i) Well, We have a horrible past, he is right now not paying child support we dont have a case for child support etc. (if im not clear let me know) our mediation Date is set for the 25th of Aug, Then we have a court date the 27th so the judge can see if the mediation was a success (i know it wont be!) And the 4th i went to the Courts and I Filed a petition to leave state Which i got Advice to do so from a legal aid. our court date for that is also the 27th of Aug, when i went there they told me to answer back to his petition to get joint custody i told them i disagree that i think he shouldnt be able to get joint if he doesnt support her in anyway. he left to south carolina for three weeks without letting me know and with all of our clothes (in june to the beggining of july) Didnt make sure she had diapers or anything! I just went on and on about how he is more concerned about me leaving state whether then her... Ok! So my real question is, Do you think the judge will rule in my favor as in Leaving state to be with my husband, i dont plan to leave til feb 2010. (my babys father and i were never married he is on the birth certificate though) also what do you think the chances are of him Getting joint custody?

That's a tough one.
Let us know when you know. I've heard of wives who had to stay behind or lose custody of their children. Then travel to "visit" their husband. You're going to have to wait it out.... |
