Custody Battle
Good Morning to all.
Are there any laws to keep American Citizen kids in USA in stead of a Parent taking them out of the country? Or will a judge incline more for keeping a US citizen child here in America? In this custody battle Mother wants to take Daughter to Mexico she is asking for full custody. Father wants daughter to stay in USA where she was born and raised. Daughter is 2 yrs 8 months. Thank you in advance all for your help. |

Is mother a full US citizen? Is she legally allowed to stay here indefinately? Is her family is US or Mexico?

File for custody of the child. Yes, judges likely frown on an American child being taken out of the country in cases such as this. Nip this in the bud now before you regret it later.

She may be able to take the child back to her home country. It will be up to the judge. Could go either way.
