hi , my sister is going thru a divorce case at this present time her ex is refusing to pay her child support because he says he doesnt need to cos they have joint custody is he in the right, i look forward to your reply many thanks, she stays in ontario

If there is no child support order, he doesn't have to pay a red cent. Plus, you said they have "joint custody", so if that is the case, why doesn't she think she shouldn't pay him instead. Why is it that if they are "sharing" responsiblity, she wants money? Maybe he should get a child support order against her. Fair is fair, right? Is it just about the money for her? Doesn't he have to provide the kids with food, shelter, entertainment, electricity, etc. when he has the kids? This is how things get screwed up because some people just can't get enough. She wants to share custody and get paid for it too?Please. No disrespect, but your sister needs to get over it and if she is short of money, she needs to get a better paying job or a 2nd job like he'd have to do. He is not with her anymore, so why should he have to continue to support her and her short falls.

Joint custody doesn't mean a 50/50 split and even if there as a 50/50 child support is still sometimes ordered.
