Texas child support stop non custodial parent

My son has been living with me now for 4 months and his mom is still reciving child support directly from my check. I need to stop this asap. He is in school and not moving back with her. What do I do? Also his mother can't be found she is moving from hotel to hotel.

Call child support with proof that you have custody of the boy. If there is no order, send them the enrollment form from his school. If this doesn't work, contact the court and ask that she is ordered to pay you back. Even though in any other situation, this woman is commiting a felony for "stealing" money, but I doubt if the courts see it that way.

the only order I know of is the order of establishing the parent child relationship. she filed on me for child support, but I have always paid that.

the order states that we are both conservators for the child and she is the managing conservator.

Then you need custody....legal custody. Are you and your ex on any sort of decent terms? Have you asked her about dropping child support?

If not, you need to file an emergency order for custody. Once you have the order for custody, you can start receiving child support from her if you choose.

OR...call the child support agency. In Ohio, they calculate the time spent with each parent. Ask what to do in your situation. You may be able to file for a modification of child support (though you won't likely recieve any unless you are declared custodial parent).

One way or another - you need to get primary custody awarded to you (the same type of custody that she has now). Or shared - if you're willing/capable of doing that. She can come back anyday and resume custody.
