Confused Sticky situation concerning custody - Michigan

My situation has gotten rather sticky. I am engaged to a man that has one child from one past relationship and two others from another. He is seeking custody of the two girls. This stems back from June of 2008 when they parted ways when he moved out. He has voiced that he made his first bad choice here when he didn't take the kids and have her move out. He said that he thought less change for the girls would be better. During this time he was over at her place watching the kids while she was at work until October 2008. In November the visits were far apart, she didn't want him to see the kids. She didn't let him see them all of December (except for 30 minutes at christmas, in to the middle of February). In December she got evicted, CPS called on her, lived with his mom and various friends. She moved into an apartement in January of 2009 with the help of an non profit organization. She left them hanging on a contract the beginning of April. She moved across state without the permission from court because of the pending custody case.
My fiance found out the end of Jan. 2009 that she put a PPO (private protection Order) out on him. He didn't know it was there until the end of March. In it, it was stated that CPS was investigating him on sexual assult on one of their daughters. It also stated that he had a physical assult on the same child. From the middle of Februay to middle of march she would bring the children over to our place and he would take them home every satuarday, alone without supervison.
My question is. She got a lawyer via legal aid. Since he is being investigated no lawyer wants to touch him until he is accused or after it is un founded. CPS has not been in contact with him nor has the cops. They told the judge that it would be wrapped up last week for sure. Does lack of contact mean something (as if they found something, or didn't). He has court again on Tuesday. I am worried. I have no doubt in my mind that he didn't do it, because he is a great father. I am just wondering if CPS will look deeper into it since it came about with the custody in question. (I should add the judge did reward him temp. full custody until the CPS thing).

Relax. It doesn't sound like you have too much to worry about, but you never know.
