Hi there advice required if possible please i have big problems my story is below.
Hello The first post i make is a most sad and distressing one for me,I live in the uk with my thai wife and our 19 month old uk born daughter had a holiday in Thailand arrived 1/4/09 we submitted another settlement visa on 3/4/09 did the online application and submitted all the docs 3/4/09 tracking system states sent to uk embassy now i'm back in england wife and baby in isaan.Wife lands a bombshell and says she no longer wants to return to the uk to live with me and intends to keep our baby girl in Thailand the baby is british passport holder no dual nationality on a tourist visa valid 21/6/09.I still hope i can talk my wife round to return to uk with our baby once visa is issued but she is also talking of obtaining a thai passport also for our baby to counter any border runs and tighten her grip of custody of our baby.I realize there probably is no thai lawyers on here but i'm desperate for any help or advice.I've checked the net and seems embassy help is little to non and looks like dealing with Thai lawyers wise in family law is the other option.Though i hope i can sort our marriage out by talking with my wife i need advice.Help anyone please. |

heya
sorry to hear about ur perdiiment!!! you said your wife took your child out of the country and is saying she doesnt want to return... when you are married both parents of a child have shared custody and guardianship of their child..you can apply to the court and make an application for the return of yor child to the uk... if this fails you can charge your wife with child abduction under the family law act as your child is a uk citizen ...good luck |

I am in a case a bite different. - Good : you are married and the child is Legally reconnized by Thai law = Automaticly you are in shared custody (i have fighted 2 years and bought it to have it) Questions: (maybe you will said i am crasy but when you fight and you are foreigner the Law is more for Thai than foreign) - Does she work and have a salary suffisant to raise the child ? - Can you prof you are paying every think since you met her? - Did she have a home ? - Can you proof she addic and play card ?(me it was easy addic to play, i callher she was playing i did call the police) - Can you proof she go often in Night club or back soon the next morning often and do not take care the children ? - Can you proof she is drunk often (pictures) or Drugs - Does she is in Madness, abnormal comportement - Can you proof she do not take care the children after recommendation of a doctor (Friends, doctors letters, invoice of hospital) "But do not take Thai witness are not reliable (in my residence all reconnized me at a good parent but the cosed the door", and try if you have some people playingcard to hide the eyes) - If the child always a purpose to get money, witness, record by mobile phone conversation, i did (but maybe the court will not lsten them) Advises: - Have you talked about money ? If she interrested by money, try to negociate is good try to let her make a letters to block the situation, She have to right it signed by her but not by you (it will block the situation) = Mostly Thai girl are interrested by money only , try to be quiet...convince her about the chance you can bring in term of futur of the children (if she come oor family, she know already..normally you should toget it.. If she is interresting by money try to fix a total amound not to low(as you are married and she can ask rent per months) >> Me have organized a meeting with her father who told me to do not speakabout money and he would think at the case, he take the child in holidays 3 days, in fact during 10 days my son was in kind of ottge to get mney each visit, i was sick to see my cild inbad healfyas i have even no right legaly reconnize as father, i did a proposal with this letters (record the conversation with mobile phone or 2 farang witness in case of she said youfight her to do it) "Go with the proof and your letter signed by her to see a lawer For the lawer: > List of Ambassy...met several of them (take farang lawer with Thai lawer) > Negociate the package price to the end of the custody as for Lawer the contract is ended at an agreement, ask also after how it is working if you obtain the custody as the Application of the law are not the same > Exige all document and charge paper in UKbefore to sign > Found a good translator (at the court take care as he translate very well as with the precipitation and tension and the judge can take themself decision you can make mistake. > For the court do not take one in up country, more on Bangkokas you will have the chance to have Judge who dd experience abroad and more open mind andknow the child will have more chance How it is working in Thailand: 1/ Charge paper is made for all stage and Thai lawer are not soft - that will make the situation with tension (you/child/mother....better to have someone of you family till this start. - if the charge paper is salted prepare yourself has she screem every where and show it at every one, craying but it is a face and a movie 2/ You will go for a meeting front of a judge, me i ahve prefered to see the judge listen me separetly and after you are together front of the judge who have took is decsion > Important for the Judges you respect the amound and what you have agree onthe letter > if she accept at that stage the money, you will have a custody shared with autority to rise the child, is the best way take it as iknowsome people fighting for 7 or 12 years and i am sure it will not possible to stay in Thailand for long timeand the child we stay with the mother will speak more time the family will influance him and at 7 year he will said i want to stay with Mamaand you will lose the full custody. At that stage possible to arrange every think with Thai, money and the interrest of the childand his futurand you will be safe. That is True, money can have a good infuance My case were solved for around 20 000 Euros included lawer without the trip iave to paid every year to the mother. Bad senario: You can not find arrangement, is proceedure of divorce If you are married on Thai law she can ask half of salary The right go on the mother for the Judge, if she is Teatcher it will really hard. If she is a bad girl and it was planned by her familly since the begin as my case try toavoid conflit... I wish you a god luck, because i have a simlard story. Take care at your security also, we do not knowin case if the situation is bad. > Take care at the child as it affect a lot > No pity, listen your lawer be patient and quiet |
