Support Arrears Texas and Federal taxes
This is a simple question just with several variables. I do not pay very much in child support, so needless to say it took a while for there to be over $2,000.00 in arrears. I was nearly at this amount during last years tax season, but got all of my return. Also, last year I used H&R Block with the advance loan. This year I have been paying both on time monthly as well as a full month of back pay. But I actually filed my return myself to maximize and not waste my return that is greatly needed within my household, even if still not a large amount.
I also thought that you were 1 supposed to owe a certain amount and 2 there was supposed to actually be paperwork filed with the IRS by the person and/or state that you owe the support payments. When I just check the status of my return it said, " Your refund MAY be reduced to pay a past due obligation such as child support, another federal agency debt, or a state income tax." I am just wondering if either of the two points are myths or are they accurate? Also, how will you know if your support is taken from your tax refund? |

The child support agency can claim your return. The reciever of child support does not have to ask them to. If you owe say $1000 now and your tax return was supposed to be $1500, you'll get the difference....but it will be delayed. If your back support is more than what you owe, you will likely not get it.
Likely has nothing to do with how you filed - or who you filed through. It's just that they got around to your case. |

Yes the goverment can and will take all your taxes, and then they will lie to you and say that it goes to your past support. It however does not. They are a bunch of theives. They will take your taxes and keep it, not give it to the Mother that has been taking care of the Child. I wouldnt even file taxes if I were you.

That's about the dumbest "advice" I ever heard. The mother doesn't have to request to have your taxes siezed. The child support agency does it. You will get the difference, the mother will get the back support (though it can take up to six months), your weekly obligation will go down if it pays off your back support. Though it sucks to realize you won't get your tax return...you might be out of a debt. |
