Actually now that the child's mother has passed away it really is her child. Dad can appoint step-mom to become legal mother/guardian I believe. My aren't we a bitter person?

its NOT HER CHILD unless she adopts. and btw, children are not property and cant be willed.if dad passes away, his family or mom's have a better chance of custody then stepmom does

In terms of the Will... anybody can Will anyone anything. They don't have to be blood related. If the OP wishes to include the child in their Will, they can do so.

Again, this poster has not been back since April of this year and it's pointless to continue to play moral police when it is a legal matter she was inquiring about. Had she wanted moral advice, she'd have written Dear Abby.
