My ex-girlfriend is haven my baby. She already has one and to me acts like a unfit mother. He is 3, He hits her(she dose nothing), she lets him do what ever he want even when its wrong, he has no bed time, she has bin smoking in the car ever since he was born(and when he was in her), his diet is mostly fast food, she leave him with her 16 year old sister to gamble or to shop(she knows nothing about kids), house is durity, the family is always fighting and curiseing(her favrite word is F*** and she said that her self), difes has bin there befor and took her younger bother out the house. I am scared for when my kid is born to live there. What are my chances of me getting full cusity.

Now...why did you get involved with a women like this?
Chances of getting full custody right away are slim to none. But smoking has been used as cause to switch custody. There was a case where the custodial parents smoked outside only, but since the child had asthma, that was severe enough - and a judge ordered a change in custody. You will need to petition the courts for parental rights and custody right away. Since the chances of being awarded custody of a newborn after the mother risked her life to bring it into this world are slim to none...you will get parenting time and child support you will have to pay. Keep involved with the child...Take any extra time you can get (offer to babysit etc). If you feel the childs health is in danger (smoking around him/her), your best bet of getting full custody would be after the age of two. You will likely need an attorney and a LOT of money. |

Your chance of getting custody at this time, based on what you have stated, is zero.
Unfortunately, you are going to have to wait until she really screws up and endangers the child before the court would even consider granting you custody. That's just the way our family court system works, so save your money for some time when you have a shot. |
