Confused Child Custody for a Father (Tennessee)

My boyfriend had a child with a girl he was dating 3 years ago, being that they both were underage their parents signed guardianship papers stating that they shared custody of the child until one of the parents turned 21. Before he turned 21, the mother left the state with her without him knowing and threatened to not let him see his daughter anymore. The mother is 19. He's been the primary caregiver for his daughter but seeing how he wasn't 21 he couldn't have custody of her. She finally came back after being gone 3 months without him having any address of where she was or a phone number. The mother lets him keep his daughter for a week then wants her back. When she asked for her back she once again threatened him with never being able to see his child, and being scared that she would leave town again he called the non emergency number and they directed him to Family and Children Services where he filed a report on his child and her sister's horrible living conditions and the fear of the mother leaving the state with her again. Family Children Services opened the case and asked for phone numbers and address so the case worker could go by the house and check on the children only to find out that once again she left town without anyone knowing. When the case worker contacted the mother, the mother was very vulgar to her and hung up the phone in the case workers face, moments after that the father got a phone calls threatening him, stating that he would NEVER see or speak with his daughter. My question is, is there any way he can file a report or petition to have the mother bring the child back to Tennessee. My other question is, is since there were papers signed at the child's birth that custody goes to the parent who turns 21 first and seeing that he is 21 and the mother is only 19, what procedure does he have to go through to actually get custody of his child or does he automatically have custody of his child and the mother has to bring her back? Really need help because we are afraid that until there is a court date we won't be able to see or talk to the daughter and we are also scared for her safety and well being, being that the mother's family has a history of suicide and incest. What can we possibly do to get his daughter back to Memphis in maybe a week. And is it legal for the mother to run away with the child and not give a paternal father any notice or address or phone number. Can the mother be brought up on any charges?

That's a crap piece of paper that the first parent that turns 21 gets custody. Probably worth as much as a used kleenax.

He needs to go to court and file a motion for custody/parenting time.

So you think the mom needs to check in with you before she leaves home for the night (or even a week)? Seek the fathers permission? PLEASE.

Without a custody order she can go wherever she wants for as long as she wants.

There needs to be a parenting plan in place with specified times.

I'd love to see the law on that. You can go to war but can't have custody of your child. Hmmm.... I've always thought the going to war but not allowed to have a beer was really out there...now this...
