Child Support for mine when husband has a lot of kids

I am trying to figure out how to ensure my children supported when my husband's past keep coming back to haunt us.

My husband and I have two children together, and he has two from previous relationships several years before. I knew about the two kids he had from the beginning and he has supported them since birth. A few years ago we went through a long legal battle for visitation which cost a lot of money and has left us financially strapped. Last week we received a letter from the court saying he must take a paternity test on a 13 yr old child from another woman in his past, and if found as a match will need to pay child support.

We can barely make it as it is, and if he has to pay support on another child (one he never even knew existed), we will lose our house. I am also feeling that at this point our marriage may not survive this news and the financial and emotional fall out. I have not made a final decision about separation, divorce, or trying to hold on.

What is the best way to ensure my children are supported? Should I file for support now (I realize my husband will need to move out) so that my order will come first? I am afraid if I wait until the results come in I may be behind this other child and end up with no support for my own children.

It sounds like the funds may be already gone. Your best best is to urge your husband to get a second job to support his children (and maybe marriage counseling). I realize then even MORE of his income will go to supporting his children, but he'll get to keep a little more too.

your husband is required to support ALL of his children, and if he cant, then he needs to stop impregnanting women, its as simple as that. and btw, WE didnt go through a battle for visitation, your husband did. you have no rights at all to any kids but yours.

wow you must really love your husband. File for support now to ensure you get paid. why don't you go to work and pay him support, what makes you think you will retain the children? and if he gets shared custody you will likely get nothing or even have to pay him anyway. They do count his other child support obligations in how CS is calculated. you sound like every mans dream come true!!!!!

This is an old post and shared parenting doesn't eliminate child support. Not even 50/50 parenting eliminates child support unless incomes are almost equal.

Ya...your definition of a mother hands over the kids to the father without delay when a family falls apart. That's surely NOT my definition.
