My Baby is only two months old, Her father (Whom is also the father of my 3 year old son) has only supervised vists with my son due to past abuse and no court arranged vists with our daughter yet, I admit he has been trying to get better, I took the newborn over to a park to have a visit with him, His name is not on the birth certificate, So I know he does not have any legal rights to her (we are not married and have not been to court) but if he is trying to get better I don't want to keep her from him.
The thing is when we were getting ready to leave he pushed me away and started loading her into his car saying he wanted to take her to see his Brother, and he would bring her back in an hour, The only reason I got her back was a man in the park came over and got involved finally he gave her back and left, I'm just wondering in case he pulls this again what can I do? Is that considered kidnapping even though he is her father would the police get involved or would I just have to wait until he brought her back? |

And once we do go to court, In the event he does get visitation, if he doesnt bring he home when he is supposed to what can I do then? Will the police get involved then or will I just have to take him back to court over it?

Once there is a court order - you will be able to get the police involved to get the baby back if he refuses to follow court orders. For now...and for your sanity...you need to find a service that offers supervised visits. Your local womens shelter should be able to assist you in locating a place that offers this.
If he does take the baby now - they may not help. Been through it myself. |

She already has a court order, so she does not need to wait for another.
The court order says he is only to have supervised visits, and probably spells out the time and/or location of the visits. If he violates it, and does not have a shared-parenting order granting him at least partial legal custody, then she does not need to wait to get the police involved. |

That is not what I gathered from her post, but regardless, (and you should really know this by now, GByte...), an unmarried father has no rights to the child, by default.

Well...that was what I took no court arranged visits to mean. Whether he has court rights or not - she should insure he has regular contact. For the following reasons:
1. It's the right thing to do 2. If it ends up in court - it will look better for her Number one being more important... |
