Default retroactive child support

My exgirlfriend left me in Jan of 2008 with our three children. she did not file for child support in the state of nevada untill october of 2008. can she sue me for child support from jan to oct?

Yes. But at least in my state she'd need to retain a lawyer.

She can sue for anything.
That does not mean she will be successful.
If she has received any form of public assistance since the birth of the child, then she will almost certainly succeed, as the State will seek to recoup its expenses from you.

TBYTE you are just plain ignorant.state is only intrested in money from child support if you are 1 afdc. 2tanf recipiant not if you are on medicae or food stamps in my state so dont speak like you know every law for every state.

She could succed whether or not she recieved state assistance. It's just the question of would SHE sue for back support or would the state.

Like they said, she can sue for anything... however, to win; assuming she is not on the welfare role (and yep, in our state you'd have to receive state assistance in the form of cash in order for that to fly, food-stamps and heath care do not apply) If (however) she's been on her own til the date she applied (which you state as Oct...) then they will charge you from the date she applied. (Date of application - at least in this state.. is the date they charge a non-custodial parent from...)

Here it takes a couple of months to get child support running so almost all non-custodial parents start with a bit of arrears on the books.

Yes, it will start at the date it's applied for. They COULD then have to go before a judge if SHE chooses to seek back support.

Kind of an important note - you will go into arrears almost instantly due to the delay of starting child support after the application is filed. As soon as you are able to start manually sending support (through the system), you can do that with an address they will provide so you don't go into arrears and have a larger then awarded amount taken until it's paid.

My daughters father went 1500 in arrears between filing and the deductions starting (took a LONG time). It tacked an extra 20 a week on the payment.

After paying 130 a week for daycare all by myself for six months though, I wasn't too sad for him.
