The father of my child is a non- U.S citizen. What actions must I take to ensure my child isn't taken from the U.S? Although we were never married I am unsure of Minnesota law pertaining to my situation.

You would by default have sole custody as an umarried mother.
Part of getting permission to go out of the country is a passport. If your child does not yet have one, do not sign for one (two parents ARE required to sign and to my knowledge they are pretty strict on this). Other than that, you may want to talk to an attorney or email the ask an attorney section of this website (it costs $10). Unless someone here has pretty direct experience with this. If you are afraid of international parental abduction though...I'd recommend you ask an attorney. Just to make sure you have all your bases covered. |

I believe that is the defintion International kidnapping if the child was born here in the US.
sidenote; if the child is a US Cit (born in the states) this is an FBI issue and has nothing to do with your state laws; which might explain why you cannot find any info on it? Last edited by lori509; Jan 26th, 2009 at 09:14 PM. |

I wouldn't trust that by default thing. where was child born even though you are in minnisota don't mean child was born in u.s. is the father on putative registrey?Is fathers name on birth certificate.By default could he take the kid?

No. By default an unmarried mother has full and sole custody.
That can only be changed by a court order after the father requests parental rights. |
