Child support arrears and taxes - NY

In NY, I owed 4000 in back child support. I have been paying now all year and still owe 3000. My federal taxes will be 3800, will they take it ALL or just what I owe in arrears since I'm still paying?

Probably just your arrears. But...expect the other 800 to be delayed, possibly for QUITE a while.

Why would they possibly hold the other $800? Is there a legal reason for this?

Bureaucracy.
They may intercept the entire amount and send you the difference. Call and ask.

It's kinda like it goes into a pile of seized tax return checks...then someone sorts through the pile figuring out who owes what. If there are any leftovers...then a check gets cut for the remainder. It might be a little more advanced than this, but I don't think so.

Could they hold the 800 incase whatever he don't pay in future $800 can apply towards his regular payment? he might miss.

They just took the arrears owed, and when the IRS said I would get my refund, I got the $800.

Now they are holding my state for whatever reason. I am clear of arrears, hope they let go of my state because I can really use it. And, since my ex gf hasn't paid support in 5 years.....but that's another story.

I'm sure it takes a bit to ensure the arrears are cleared. Hopefully - they see it is and you'll get your refund!
