Default The child does not have a bedroom to sleep in, she sleeps on the couch

I need your help!!!
My fiance has primary custody of his daughter in Georgia. His ex wife has secodary custody with every other weekend visitation. She was suppose to take a parental class but has failed to do so and is behind in her child support payments. In his divorce paperwork, it only stipulates that he has to give her 30 days notice of moving. We are planning on moving out of state. She has filed an injunction and is trying to get custody of the child (the child is 11 years old). The ex-wife lives in a one bedroom apt with her boyfriend and is expecting a child, so the child does not have a bedroom to sleep in, she sleeps on the couch during her weekend visits.
Does she have a shot at getting custody? What is our best defense?

Not likely unless there are some real and changed circcumstances--the court has already looked at this and decided--but let us know here how it goes!
