Confused Grandparent visitation rights (New York State)

New York State
Is there a legal action a grandparent can pursue to gain the right to visit a grandchild? Child's parents are not divorced, but they are preventing me from visiting my one grandchild.

Grandparenting rights laws are kind of in a iffy state now. Especially if both biological parents are alive, raising the child and object to involvement. New York is kind of different. An attorney would probably be your best bet. Maybe even the low cost ask an attorney section on this site could offer guidance.

And if that doesn't work...I'd say you try and figure out whatever they have against you if you don't already know, beg forgivness (even if you don't feel you should) and ask for a second chance to be in your grandchilds life again. Then...don't make the same mistakes twice (ie being judgemental about parenting styles, decisions, etc).

Try to put yourself in their shoes....

I agree completely. It's on the news so often and generally is overstated. The truth? Usually there isn't grandparent's rights. I think (mostly) it's assumed by the courts that I will allow my children to see my mom and dad and that my X will do the same. I agree with Gbyte your best bet is to make up with your own son or daughter.

Grandma I'm sorry but there is no such thing as grandparent's rights it's a media created issue. In courtrooms it does not exist. sorry.

Welll....it does exist IF the grandparents child (who is the parent of the grandchild) dies.

There are third party laws in Ohio that if it can be shown to be in the best interest of the child, a non-parent can win "visitation". But it's a TOUGH sell. If both parents think it is not in the best interest of the child to see a third party on a regular basis, that is likely to be the decision by the court as well.

Ohio is getting better about both grandparent visitation and even custody. See In re Z.A.P. Washington County, Ohio, decided 7-2-08. There does not have to be a deceased parent for grandparent visitation in Ohio. Grandparents can and are getting visitation in divorce cases as well as cases where the parties were not married. See

the onyl way you can see your grandchild is make nice with the parents, they control who has contact with their child.
